COMMENTARY

Since Bylaw No. 2268 includes amendments to the Official Community Plan, a Public Hearing is required in accordance with the Local Government Act.

Public notifications for the Public Hearing on Bylaw No. 2268 have been placed in accordance with Section 466 of the Local Government Act.

The information considered by Council in relation to Bylaw No. 2268 and Bylaw No. 2269 can be found at the following link to the City’s website: Special Council Meeting - June 29, 2026. This link also includes the video recording of the comprehensive presentations regarding the new Design Guidelines and Environmental Development Permit Area Guidelines included in Bylaw No. 2268.

Since the Special Council Meeting on June 29, 2026, Staff made three minor amendments to the Form and Character Design Guidelines to improve clarity.

LEGAL IMPLICATIONS

Section 470 of the Local Government Act states that Council may do any of the following without further notice following a Public Hearing:

  • Adopt or defeat the Bylaw; or
  • Alter and then adopt the Bylaw, provided that the change does not alter the use, increase the density, or, without the owner’s consent, decrease the density in comparison to the bylaw that received Public Hearing.

Sections 477(6) and 480 of the Local Government Act authorize Council to adopt an OCP bylaw and a Zoning bylaw, respectively, at the same meeting that the bylaw passed third reading if there are no conditions or external approvals required. No conditions or external approvals are required prior to the adoption of Bylaw No. 2268.

Should Council give 2nd and 3rd Readings at this meeting but defer consideration of adoption to a later date, it is important to note that Council may not receive any new information during that time.

There are no public notifications, conditions, or external approvals required in relation to Bylaw No. 2269.
