Administration

SUBJECT:

Lease Renewal for Payline by ICE Inc. for 315 – 877 Goldstream Avenue

BACKGROUND:

On December 16, 2021, the City purchased 315 – 877 Goldstream Avenue from 676955 B.C. Ltd. for $655,000.00, to allow for future expansion of City Hall office space. Unit 315 has an existing tenant, Payline by ICE Inc. (“Payline”), and it was a condition of the sale that the lease be assigned to the City as landlord.

Payline has been a tenant at 315 – Goldstream Avenue since 2011. Since assuming Payline’s tenancy, the City has not had any issues with Payline as a tenant. Payline desires to continue their lease in the current location.

The City does not currently have plans to utilize this space. The City has recently ended its lease with City University and will use that space to accommodate growth in the near future. Staff does not recommend a lease for a term of longer than a year at this time as further growth may result in a need for the space and a short lease time with the option to renew or extend provides maximum flexibility for the City and a degree of certainty for the tenant.

COMMENTARY:

City staff recommend entering into a lease renewal with Payline in substantially the form attached. The terms of the lease renewal are the same as the original lease, those key terms being:

  • The term of the lease renewal shall be one year;
  • Payline will pay the base rent each month, plus GST;
  • Payline will pay all property taxes for the unit each year;
  • Payline will pay all utilities when due;
  • Payline will keep in force insurance for the property in the amount of $5,000,000.00.

The basic rental amount for the term of the lease renewal is $37,646.04 per year, to be paid in monthly installments of $3,137.17, plus GST. The rent is based on a price per square foot of $25.73, which is consistent with market rental prices for office space in Langford. The rent has been increased 5% from the previous term.

FINANCIAL IMPLICATIONS:

Payline will pay rent to the City in the amount of $37,646.04 for the term, in equal monthly installments.

LEGAL IMPLICATIONS:

The City will be bound by commercial tenancy laws as a landlord, and shall be obligated to fulfill the terms of the lease, attached.

OPTIONS:

Option 1

THAT Council authorize the Mayor and Chief Administrative Officer or Corporate Officer to enter into the lease renewal with Payline in substantially the form provided;

OR Option 2

THAT Council not renew the lease agreement with Payline at this time.
