Staff Report to Council - Addendum Report (2) (Z21-0048) - 2750 Leigh Road

DATE: Monday, June 20, 2022
DEPARTMENT: Planning
APPLICATION NO.: Z21-0048
SUBJECT: Addendum Report (2) - Application to amend the MUE1 zone by adjusting the boundary between Areas A and B, allowing non-residential gross floor area within Area B to exceed 9,290 m2, and to introduce a new parking ratio for light industrial uses within Are

BACKGROUND:

At their regular meeting of May 16th, Council made the following resolution in regard to the above noted application:

That Council proceed with First Reading of Bylaw No. 2028 as amended, which includes the altered parking ratio of 1 per 100 m2 of gfa of light industrial uses in Area A of the MUE1 Zone and direct staff to review the actual parking demand after Phase 1 is complete.

A new habitat restoration requirement is now proposed to be included with this application.

COMMENTS:

The current MUE1 (Mixed Use Employment 1) Zone states that no more than 150 m2 of non-residential gross floor area and no more than 3 residential dwelling units may be constructed on the lands until the owner has completed the following:

a) Consolidated the lands that are within the MUE1 Zone;
b) Entered into an agreement with the City of Langford, to the satisfaction of Council, to provide to the City;
i. $1,000,000 towards the City’s General Amenity reserve fund; OR
ii. An alternate amenity with a demonstrable value equivalent to $1,000,000; OR
iii. (iii) A transfer of 15% of the lands located within MUE1 Zone to the City of Langford; OR
iv. Some equivalent combination of (i) and/or (ii) and/or (iii);

In addition to the above noted items, the owner has agreed to ensure that at least 15% of the lands will be relandscaped as habitat restoration and greenspace areas, to be demonstrated within their environmental development permit application. They have also agreed to remove all invasive species within any lands to be dedicated to the City within one year of bylaw adoption. These areas are to be replanted with appropriate native species as determined by the project biologist. Should Council wish to proceed with implementing these requirements, they could do so by having the applicant register a Section 219 covenant.

As this would result in up 30% of the land at 2750 Leigh Road being utilized as open space or habitat restoration areas, Council may wish to proceed with adding this condition to Bylaw No. 2028.

Council may also wish to note that the consolidation of the lands within the MUE1 Zone has already been completed as required by the existing MUE1 zone.

OPTIONS:

Option 1
That Council proceed with 2nd and 3rd reading of Bylaw No. 2028 as drafted subject to the following conditions:

  1. That the applicant provides, prior to Bylaw Adoption, a Section 219 covenant, registered in priority of all other charges on title, that agrees to the following:
    a. That 15% of the property at 2750 Leigh Rd will be relandscaped as habitat restoration and greenspace areas, demonstrated by a plan prepared by the project biologist as part of the environmental development permit;
    b. That all invasive species shall be removed from any lands to be dedicated to the City within one year of adoption of Bylaw No. 2028 and that these areas will be replanted with appropriate native species as determined by the project biologist.

OR

Option 2
That Council take no action at this time with regards to the proposed habitat restoration areas and proceed with 2nd and 3rd reading of Bylaw No. 2028 as drafted.
