8.e Disposition of a Portion of 1990 Bear Mountain Parkway to two Riviera Parcels - Staff Report (Land Development)

Key facts

  • Property involved: portion of 1990 Bear Mountain Parkway
  • Report pages: 115-139
  • Subject: road/land disposition to two Riviera parcels (terms and conditions)

Staff Report to Council

Date: April 19, 2021
Department: Land Development
Subject: Disposition of a Portion of 1990 Bear Mountain Parkway

Background

The owners of 2227 and 2231 Riviera Place have offered to purchase the circled portion of an adjacent Fee Simple City Amenity Lot addressed as 1990 Bear Mountain Parkway and shown as Lot 40 below in order to upgrade the landscaping and expand their rear yards.

Map showing Lot 40 and the subject area adjacent to Riviera Place; circled areas for 2227 and 2231 Riviera Place

Commentary

The Amenity Lot was created by the Riviera and Pinehurst subdivisions and transferred to the City this year as a contribution to the 40% Open Space required by the Resort Community of Bear Mountain 2 Zone. The Parks Department has confirmed the land is not suitable for a trail connection due to the challenging grades. The land in the subject area falls steeply down from the road and contains storm sewer infrastructure that discharges to a small ephemeral creek. The Owners have installed landscaping to the satisfaction of the City Engineer that maintains the functionality of the stormwater works. A Statutory Right of Way has been prepared.

At their meeting of January 18th, 2021, Council passed the following resolution: a) That Council direct staff to enter into a purchase and sale agreement with the owners of 2227 and 2231 Riviera Place for the disposal of approximately 100 m2 of Lot 40, Sections 83 and 84, Highland District, Plan EPP101118;
AND
b) Direct staff to post public notice as prescribed in the Community Charter for a land disposition.

The City and the Owners have entered into a Purchase and Sale Agreement. A Consolidation Plan and Statutory Right of Way have been prepared. The Owners have completed the required landscaping within the SRW area. The City has published notice of the disposition in accordance with Section 94 of the Community Charter on April 7th and 14th, 2021.

Financial Implications

The owners have offered to pay $15,000 for approximately 100m2 as well as all legal, construction and landscaping costs. The City would receive increased property tax revenue due to the increased lot size, while reducing maintenance costs as the owners would maintain the area in perpetuity.

Legal Implications

The City can dispose of land received as an amenity when the operational needs of the City have changed. The Lands must be disposed in accordance with the requirements of the Community Charter and Local Government Act. Notification must be provided to the public in accordance with these Acts and Council policy.

Options

That Council:

  1. Proceed with the sale of a portion of 1990 Bear Mountain Parkway and authorize the Mayor and Chief Administrative Officer to execute the agreement with minor amendments as required based on the terms as attached.

Or

  1. Take no action at this time with respect to 1990 Bear Mountain Parkway.

Respectfully submitted,
