Subject
Page Avenue Road Closure and Disposition Bylaw No. 1643
Background
The owners of 946 and 948 Page Avenue have approached the City and requested to purchase a portion of Page Avenue fronting their properties. On June 17th, 2017 Council accepted their proposal and passed a resolution directing staff to proceed with the closure and disposition as put forward by these owners.
Comments
The owners have worked out an agreement with their home insurance company who will cover their costs through title insurance, and the insurance company have retained a lawyer and surveyor who have completed the necessary work to now bring forward the closure bylaw. Notifications have been placed in a local newspaper as required though provincial legislation.
Financial Implications
For this closed portion of road that amounts to 221.4m², the City would receive a total of $73,000. The costs associated with this closure and disposition would be the responsibility of the two owners.
Legal Implications
There are no known legal implications with the sale and disposition of these portions of Page Avenue. However, BC Hydro and Corix have both requested SRW’s for any of their services that may be located within the proposed road closure. Council may wish to request these SRW’s (if required) are included in the final registration package.
Options
That Council:
- Give Page Avenue Closure Bylaw No. 1643 1st, 2nd, and 3rd readings;
AND
- Require the applicants to include any necessary statutory right of ways with the final registration package.
OR
- Take no action at this time with respect to Page Avenue Closure Bylaw No. 1643.
