Staff Report to Council

Date:

January 8, 2018

Department:

Planning

Subject:

First Reading Report for Bylaw No. 1742, a bylaw to amend a portion of Luxton Road from P4 (Park and Open Space) to BP2 (Business Park 2A – Sooke Road West) and Bylaw 1737 a bylaw to amend Neighbourhood policy area to the Business or Light Industrial designation within the Official Community Plan.

On January 16th, 2017, Council was presented with a rezoning application, Z16-0024, to amend the zoning of 2869 Sooke Road and 3370 and 3344 Luxton Road from the RR2 (Rural Residential 2) zone to the BP2A (Business Park 2A – Sooke Road West) zone. The Official Community Plan designation for the area did not require an amendment as it was appropriate for the uses being proposed through the rezoning application.

As part of the staff report for this rezoning application, a preferred road dedication plan was presented that included closing Luxton Road at Marwood Avenue and extending Marwood Avenue through the property to Sooke Road. While closing this portion of Luxton Road was considered as part of the rezoning application, this portion of land created from the closure was not included in the application to rezone.

Bylaw 1670, to amend the zoning of 2869 Sooke Road, 3370 and 3344 Luxton Road was adopted by Council at their December 4th Council meeting.

After a road closure bylaw has been adopted by Council, the closed portion of Luxton Road may be integrated into the development plans for 2869 Sooke Road and 3370 and 3344 Luxton Road. In order to facilitate this, the closed portion of Luxton Road must be rezoned, and its policy designation amended, to allow development to occur on this section of land. All highways in the City of Langford have the same zoning and policy designation as the parcel adjacent to them, extending to the midpoint of the highway. Therefore only a portion of closed road will have to be rezoned, and its policy designation amended to align with the subject properties.

Bylaw 1742 will amend the zoning of the portion Luxton Road and align it with the zoning of the properties 2869 Sooke Road and 3370, 3344 Luxton Road, from the P4 (Park and Open Space) zone to the BP2A (Business Park 2A – Sooke Road West) zone.

Bylaw 1737 will amend the Official Community Plan designation of the closed portion of Luxton Road from the Neighbourhood to the Business or Light Industrial designation to align it with the rest of the properties subject to the rezoning, Z16-0024.
