Background

Council adopted Bylaw No. 1209 in June 2009 as part of Z08-0006 to rezone the South Skirt Mountain lands to a new Comprehensive Development Zone (CD12). This rezoning application resulted in the registration of a Master Development Agreement (MDA) covenant to secure Council’s conditions of approval. These conditions included a master plan indicating which portion of the properties could be developed and which portions would be dedicated to the City as Open Space.

Council adopted Bylaw No. 1622 in July 2016 as part of a text and map amendment rezoning application (Z16-0001), which altered several provisions of the CD12 Zone and MDA.

Council adopted Bylaw No. 1630 on May 2nd 2016 to establish a Local Service Area with respect to the extension of Bear Mountain Parkway from Bear Mountain village to the Leigh Road Interchange.

Commentary

Works to construct Bear Mountain Parkway under the provisions of the Local Service Area have begun and as such, staff have been in discussions with the land owners and relevant external agencies with regards to servicing requirements and design. As part of these discussions, one of the owner groups, Southpoint Partners, has been approached by CRD Water with a request to locate a water pump station and future reservoir on one of their parcels. CRD Water has specific requirements with regards to these facilities, in that the parcel must be at an elevation of 228m and located adjacent to Bear Mountain Parkway. The parcel shown in Figure 1 below has been identified as the only location suitable for these facilities.

This particular parcel has been identified as Open Space in the Master Plan approved by Council as part of both the original and more recent rezoning applications noted above. This parcel is intended to be dedicated to the City undisturbed unless park improvements are approved by the Parks Manager. Due to this, Southpoint has requested confirmation that the City does not object to making this parcel available to CRD Water for the purpose of establishing a pump station and reservoir, and furthermore, that the land required for this purpose will still be counted as Open Space in relation to the requirement to provide 40% of the lands within South Skirt Mountain (CD12) as open space.
