Subject: Municipal Boundary Extension Application to the Minister of Community, Sport and Cultural Development;

Background

On October 28th and November 2nd, 2016, the City placed a notice in the Goldstream Gazette advising electors of the City of Langford of an opportunity for an Alternative Approval Process (AAP) for a proposed boundary extension of the municipal boundary into the District of Metchosin (Centre Mountain).

This AAP was available to the electors of Langford until 4:30pm on Friday, December 2nd. As of that day and time the City received no (0) responses from electors.

On January 3rd, 2017 the City of Langford published the following notice in the BC Gazette:

PROPOSED BOUNDARY EXTENSION
Notice is hereby given that under Section 12 of the Local Government Act, that the Council of the City of Langford intends to petition the Minister of Community, Sport and Cultural Development requesting an extension of the area of the municipality to include the following described lands:

And further take notice that the City of Langford intends to proceed with the boundary extension request to the Minister of Community, Sport and Cultural Development for consideration, given that the City has:
• provided the electors with an alternate approval opportunity; AND

For the purpose of conducting the alternative approval opportunity, the number of electors for the City of Langford is calculated as 22,940.

This is the first and last publication of this notice in The British Columbia Gazette.
— City of Langford, Jim Bowden, Administrator.

Commentary

Having completed the AAP and provided notice in the BC Gazette, Council may now formally request that the boundary of the City of Langford be extended, in accordance with the proposal outlined in the AAP process.

Financial Implications

The City of Langford will benefit from additional taxable land through this boundary adjustments. Separate agreements about tax sharing may limit the tax benefit to something other than what would be otherwise normally be expected from land within the municipality, but regardless this boundary extension will be a positive tax benefit to the City.

Legal Implications

None. The City is compliant with all requirements precedent to making this request to the Minister.
