Subject

Nuisance Abatement Bylaw No. 1501, 2016

Background

Previously, Council asked staff to explore mechanisms of implementing a regulatory Bylaw designed to deal with the abatement and cost recovery of nuisance situations at properties around Langford as they might emerge. Legal input was obtained and a draft Bylaw was presented to the Protective Services Committee for a review. Subsequently, Council resolved to support the Committee recommendation:

“That Council adopt City of Langford Nuisance Abatement Bylaw No.1501 as presented”

Commentary

There have been incidents in the past where Council, the Fire Department, the RCMP and our Bylaw Enforcement Officers have encountered a limited means of firmly dealing with problematic properties which will demand high incidents of Police, Fire or City Staff attention and calls for service. The Nuisance Bylaw 1501 creates a mechanism by which the City might apply a “user pay” process when faced with such demanding properties.

Financial Implications

This Bylaw will allow for certain costs, stemming from proven vexatious circumstances, to be charged to the property owner which in turn could foster better efforts toward compliance and a heighted respect for surrounding neighbourhood(s).

Legal Implications

None anticipated.
