Subject: Inter-Municipal Servicing Agreement District of Highlands Tennis Facility
Background
Ecoasis, the current owner of the Bear Mountain Resort lands is constructing a Tennis Facility on Bear Mountain behind the North Langford Recreation Center building.
The Tennis Facility is located inside the District of Highlands. There are no existing sanitary services inside the District of Highlands. The subject property is contained within the Urban Containment Boundary as defined by the Regional Growth Strategy and is able to be connected to sewer and water should it be available.

Commentary
Ecoasis has applied to the City of Langford to connect the Tennis Facility to the Langford sanitary sewer system.
In order to provide piped sanitary sewer services to the Tennis Facility, the property has to be serviced from an existing location shown on Figure 1 (above) that is inside the ceremony circle at the back of the Westin Hotel building. The City of Langford has an existing Statutory Right of Way over the sanitary services shown on that Figure 1. The existing services are owned/operated/maintained by West Shore Environmental Services Inc. (WSES). WSES has confirmed that there is capacity within the sewer main to accommodate the Tennis Facility.
The applicant is aware there are fees associated with the proposed connection and that these fees would be negotiated as part of an inter-municipal servicing agreement.
At this time the proponent is requesting consideration of an inter-municipal servicing agreement to allow connection to the sanitary sewer. Staff has considered the City’s options in this regard and are recommending that an inter-municipal servicing agreement for sanitary servicing be undertaken.
Financial Implications
The applicant is aware of the fees associated with the WSES/Langford sanitary sewer system.
Legal Implications
Inter-municipal servicing agreements are undertaken from time to time between municipalities and are allowed under the Local Government Act. Staff does not see any legal implications to this proposed agreement.
Options
That Council direct staff to:
- Enter into an inter-municipal servicing agreement with the District of Highlands for the Tennis Facility property;
- OR
- Not enter into an inter-municipal servicing agreement at this time.
