## Staff Report to Council

**DATE:** Monday, June 1, 2026
**DEPARTMENT:** Planning
**APPLICATION NO.:** OCP25-0002 and Z25-0009
**SUBJECT:** Bylaw No. 2253 and 2254 – Application to Amend the Official Community Plan Designation and Rezone 602 Madrona Place

### Executive Summary

Reid Kaufmann of Langford Heights Development LP has applied to amend the Official Community Plan designation of 602 Madrona Place from ‘Employment Lands’ to ‘Complete Community’ and to rezone this parcel from ‘Business Park 9 - Millstream Road Northeast (BP9)’ to ‘One- and Two-Family Residential (R2)’. These applications address mapping errors from the previous application that did not include this lot in the residential portion of the Langford Heights development. The proposed changes would facilitate the future creation of three residential lots.

### Background

#### Previous Applications

- OCP20-0007 and Z20-0027 were adopted on May 10, 2021. The OCP was amended to change a portion of the Langford Heights development site from ‘Business or Light Industrial’ to ‘Neighbourhood’ and the zoning changed from ‘Commercial Recreation 1 (CR1)’ to ‘Business Park 9 - Millstream Road Northeast (BP9)’ and ‘One- and Two-Family Residential (R2)’.
- DP21-0055 was issued in 2021 to allow for site preparation and construction works within the Potential Habitat and Biodiversity, Riparian, Steep Slopes, and Intensive Residential Development Permit areas within 2207 Millstream Road.
- OCP23-0002 and Z23-0019 were adopted on July 15, 2024. Both of these applications fixed a mapping error along the western side of the residential portion of Langford Heights.

### Site and Surrounding Area

The subject property is located at the south end of Madrona Place, which itself is located off Trudie Terrace in the Thetis Heights area. The property has been cleared, leveled, and prepared for residential development, except for the easternmost 10m of the property, which is designated as a non-disturbance area by the issued Development Permit.

Newly created lots within the residential subdivision on Madrona Place are now seeing homes built and residents moving in. The new homes along Madrona Place are in keeping with the existing neighbourhood to the east, which consists of single-family and two-family homes.

To the west but not connected to Madrona Place except by an emergency access route, is the business park component of the overall development. This area has been cleared and graded, in preparation for business park uses. Millstream Creek traverses through the business park area and flows along the south side of Madrona Place.

## Commentary

### Development Proposal

As previously noted, the proposal is to address a mapping error, as the final subdivided lot boundaries did not align with those anticipated as part of the original rezoning application from 2020. Rezoning this site to match the zoning along Madrona Place would allow for a subdivision and boundary adjustment with the neighbouring lot to the north, resulting in three residential lots. This amendment would facilitate the continued development of residential lots, which is more compatible with the rest of the street.

**Figure 1: Subject Property**

Figure 2 below illustrates the proposed subdivision, including the boundary adjustment with the neighbouring property to the immediate north.

To remain consistent with the Environmental DP that was previously issued for this site, Council may wish to require the registration of a covenant securing the 10-metre wide non-disturbance area along the eastern side of these lots, so it aligns with the non-disturbance areas on the residential lots to the north.

### Proposal Data

| Item | Permitted by BP9 (Current Zone) | Permitted by R2 (Proposed Zone) |
|---|---|---|
| Permitted Uses | • Wide range of business and light industrial uses in enclosed buildings | • One or Two-Family Dwellings (with suites)
• Townhouse |
| Density (FAR or size) | 3.0 FAR | 400 m² |
| Height | 32 m | 11 m |
| Site Coverage | 20% min and 80% max | 50% max |
| Front Yard Setback | 4.5 m | 3.0 m (to the house)
5.5m (to the garage) |
| Interior Side Yard Setback | 0.0 m (to Business/Industrial zones)
6.0 (to residential zones) | 1.5m (5.0 ft) |
| Exterior Side Yard Setback | 0.0 m (to Business/Industrial zones)
6.0 (to residential zones) | 3.0 m (to the house)
5.5m (to the garage) |
| Rear Yard Setback | 0.0 m (to Business/Industrial zones)
6.0 (to residential zones) | 3.0 m |
| Parking | Dependent on use | 1 space per unit |

The current practice of requiring electrical heat pumps for each house has already been secured at the time that the parent parcel was subdivided. However, Council may wish to require that a covenant be registered to ensure the garages are used for the parking of vehicles and not storage of items that prevent the parking of vehicles, and that all concrete onsite comply with the City’s Low Carbon Concrete Policy.

### Council Policy

#### Official Community Plan

The Official Community Plan (OCP) Bylaw No. 2200 designates the subject property as “Employment Lands”, which the OCP defines as ‘limited to light industrial land and limited accessory or small-scale retail and office space’. As these types of uses would not be in keeping with the existing surrounding uses along Madrona Place, Council may wish to be supportive of the proposed amendment that would designate the subject property as “Complete Communities”. As per the OCP, Complete Communities are described as:

[Image 3: OCP description of Complete Communities]

The proposed amendment and rezoning would complete this end of the cul-du-sac with compatible residential uses. The current OCP map (Figure 3) helps illustrate the location of the subject property in relation to the Employment Lands and Complete Communities designations.

### Design Guidelines and Development Permit Areas

An Environment Development Permit (DP) was previously issued to address the designated DPAs. No additional DPs are required to address environmental concerns.

Similarly, a Form and Character DP was issued prior to the subdivision of the lots along Madrona Place. Therefore, the requirements of that DP already exists on title and will automatically fall to any new title created by a future subdivision.

### Infrastructure

Full frontage improvements and works required by other related plans were completed in accordance with Bylaw 1000 as part of the subdivision that created the existing residential lots. However, Council may wish to require confirmation that the previously approved plans and works adequately address the current proposal to the satisfaction of the Director of Engineering. Items to confirm would include the approved civil servicing plans and the storm water management plan. Additional items that Council may wish to require prior to subdivision approval include a construction parking management plan and mitigation plan in accordance with Bylaw 1000, as well as a comprehensive geotechnical plan.

### Financial Implications

Source pages: 14–24

## Financial Implications

Rezoning the subject property to permit a residential development will eventually increase municipal revenue due to the number of units created. As the developer is responsible to complete all frontage improvements, the direct capital costs to the City associated with this development will be negligible. A summary of Amenity Contributions and Development Cost Charges that the developer will be expected to pay, is outlined in Tables 4 and 5 below.

### Council’s Amenity Contribution Policy

The amenity contributions that apply as per Council’s current Affordable Housing and Amenity Contribution Policy are summarized in Table 4 below, based on a total density of one residential lot since credits are given to exiting lots that already paid these charges:

**Table 4 – Amenity Contributions per Council Policy**

| Amenity Item | Per unit | Total |
|---|---:|---:|
| General Amenity Reserve Fund | $6,000 per residential lot 550m² or greater | $6,000 |
| Affordable Housing Reserve Fund | $1,000 per residential lot 550m² or greater | $1,000 |
| **TOTAL POLICY CONTRIBUTIONS** | | **$7,000** |

**Table 5 - Development Cost Charges**

| Development Cost Charge | Per Lot Contribution | Total |
|---|---:|---:|
| Roads | $5,876 | $5,876 |
| Park Improvement | $3,146 | $3,146 |
| Park Acquisition | $211 | $211 |
| ISIF | $495 | $495 |
| ISA | $52 | $52 |
| Subtotal (DCC’s to Langford) | | $9,780 |
| CRD Water | $2,796 | $2,796 |
| School Site Acquisition | $1,000 | $1,000 |
| **TOTAL DCC’s (estimated)** | | **$13,576** |

### Legal Implications

Source pages: 14–24

## Legal Implications

Should Council choose to proceed with consideration of Bylaws 2253 and 2254, a Public Hearing will be scheduled in accordance with the requirements of the Local Government Act.

The amenity contributions specified in Table 4 above are incorporated into Bylaw No. 2254 and will be payable at the time of subdivision approval along with the current Development Cost Charges specified in the various DCC Bylaws.

Council’s other conditions of approval would be registered in a Section 219 Covenant in priority of all other charges on title prior to consideration of Bylaw adoption.
