## EXECUTIVE SUMMARY

The purpose of this staff report is to seek Council’s approval to award the construction contract for the Westwind Drive Retaining Wall Replacement project to the lowest bidder, Don Mann Excavating Ltd., at an amount of $615,958.00 plus GST. A cost-savings change order will be issued post-award for the preferred optional items. The project was tendered publicly on BC Bid and closed on Thursday, March 14, 2023. A total of two (2) bids were received. In accordance with the City’s Purchasing Policy, all bids were opened and witnessed publicly. All bids were confirmed by the consultant to be fully compliant with the tender conditions with pricing corrected in accordance with the tender terms.

### BACKGROUND

## BACKGROUND

There are five homes on Westwind Drive that are located on a secondary access road (also called Westwind Drive, hereafter referred to as “Lower Westwind Drive”) that descends off the north side of the primary road (hereafter referred to as “Upper Westwind Drive”). A series of old retaining walls downslope of Upper Westwind Drive pre-date the incorporation of the City of Langford by at least a decade. The walls range in material including cast-in-place concrete, rock-mortar, and cinderblock. The walls are situated within the Westwind Drive public road right-of-way and are considered inherited assets under the maintenance responsibility of the City of Langford, since they contribute to the retention of public infrastructure, that being Upper Westwind Drive. See Figure 1 for the approximate location of the Westwind Drive retaining wall.

Upon receiving a report from a resident that cracks were appearing between the rocks and mortar, the City engaged Ryzuk Geotechnical (Ryzuk) consulting services to inspect and comment on the stability of this section and the surrounding wall. Ryzuk installed crack monitors, as well as made recommendations for removal of some trees on the slope above the wall to reduce upslope weight and wind loads on the walls below. See Figure 2 for the approximate location of the cracks and extents of the retaining wall replacement.

Monitoring took place over a few months, culminating in a report in August 2018 concluding that overall movement during the monitoring period had been minor and that there were no urgent concerns “regarding the global stability of the wall under normal static conditions”. Monitoring of the slope continued over four years until Ryzuk submitted an update report dated December 9, 2022. This report concluded that additional movement and cracking had been noted in the walls, likely accelerated by the extreme weather events of November 2021. The report recommended that City of Langford replace some of the existing retaining walls or at least reduce the load on the existing lower walls by building a new retaining wall behind them.

Upon receipt of the subsequent report, the City engaged Ryzuk to develop a replacement wall design. Design took place in early 2023 with the project being put to tender in July 2023, with Kerr Wood Leidel being retained to draft tender documents and perform contract administration. Unfortunately, the tender package received no bids and the project was postponed.

After tender package modifications in late 2023 and early 2024, the project was again put to tender on February 22, 2024 with additional options for the bidders. The latest design involves the installation of a new soldier pile (H-Pile) retaining wall using H-Piles the City already owns from a previous project. Included on the tender are optional items of using pre-cast concrete panels for lagging between the piles (the default material being smooth-finished shotcrete) and two choices to replace the lower rock-mortar wall, either with a new rock-mortar wall or with verti-block.

Included in the tender is the requirement to pull back overgrown ivy on a segment of retaining wall that has not yet been inspected. Staff recognizes there is a possibility that this segment, once inspected by a geotechnical professional, may also need to be repaired, supported, or replaced.

### COMMENTARY

## COMMENTARY

The Westwind Drive Retaining Wall Replacement project was tendered publicly on BC Bid and closed on Thursday, March 14, 2023. A total of two (2) bids were received. In accordance with the City’s Purchasing Policy, all bids were opened and witnessed publicly. The bids were then reviewed by the project consultant, Kerr Wood Leidel (KWL). A summary of the tender bid price results is provided below, listed in order of total bid price, corrected in accordance with the tender terms, and based on the consultant’s tender evaluation. The bid prices are listed exclusive of GST because the City claims the GST back. All bids were confirmed by the consultant to be fully compliant with the tender conditions.

### Tender Results (all excluding GST)
| Bidder | Total Price without Options | Total price with options / notes |
|---|---:|---|
| Don Mann Excavating Ltd. | $615,958.00 | [no shotcrete, with mortar and precast panel options $603,317.00] |
| Copcan Civil LP | $686,308.60 | [shotcrete, with mortar option $715,568.60] |

In the case of Don Mann Excavating Ltd.’s bid, the optional item of pre-cast concrete panels was priced lower than the shotcrete price within the project tender, so KWL recommends that this option be taken to reduce costs and result in a more aesthetically pleasing finish. However, as per the consultant’s recommendations, the award should be made based on the Total Price (excluding GST and not including optional items), with the City moving on the optional items post-award. In any case (with or without optional items), Don Mann Excavating Ltd. is the lowest bidder; therefore, staff recommend awarding the construction contract for the Westwind Retaining Wall project to Don Mann Excavating Ltd., at an amount of $615,958.00 plus GST.

### FINANCIAL IMPLICATIONS

Source pages: 108–112

## FINANCIAL IMPLICATIONS

The approved budget for the Westwind Retaining Wall capital project was increased from $252,500 in 2023 to $674,382 in 2024, based on the consultant’s construction cost estimate excluding GST but including soft costs and contingency. With the lowest bid being $615,958.00 excluding GST for the construction contract and excluding soft costs and contingency, the total project cost may exceed the overall budget. The project is included in the 2024 Capital budget funded from the General Amenity Reserve Fund and if the total project cost exceeds the budget the overage will also be funded from the General Amenity Reserve account.
