### DEPARTMENT
Land Development

### APPLICATION NO.
Z22-0038

### SUBJECT
20231120 - Road Closure and Disposition 726 Percy Place

### EXECUTIVE SUMMARY
This road closure and disposition is being proposed to facilitate the rezoning of 2703, 2707, 2711 Claude and 726 Percy Place and the development of an apartment building with approximately 107 residential units. The road closure will allow the reconfiguration of Percy Place to create a safe connection between Veterans Memorial Parkway and Claude Road which is a condition of rezoning.

### BACKGROUND
At the August 21, 2023 meeting, Council gave Bylaw 2139, 2023 second and third readings and directed staff to Proceed with a road closure bylaw for a portion of the Percy Place cul-de-sac abutting 726 Percy Place, subject to the dedication of a 7.5 m width half road connecting Percy Place to Claude Road. Kyle Stewart of Empowered Development Ltd has requested the City close a portion of Percy Place such that it can be consolidated with 726 Percy Place as shown below in Figure 1 – Road Closure Proposal.

[Image 1: Road Closure Proposal map showing Closed Road, New Road, and 726 Percy Place]

As a condition of adopting rezoning Bylaw No. 2139, 2023, amending the R2 (One-and Two-Family Residential) Zone to the CC1 (City Centre 1) Zone, and allowing the development of a six storey apartment building with approximately 107 residential units, the applicant has agreed to dedicate road that will connect Percy Place to Claude Road. The new through road will mean that Percy Place will no longer be required to terminate in a cul-de-sac and it is proposed that the surplus portion of Percy Place be closed and consolidated with the adjacent parcel to create a larger, more uniform building area and a more functional road alignment.

### COMMENTARY
Percy Place currently terminates in a cul-de-sac shown below as Figure 2 – Subject Properties. All residents living on Percy and Dinan access their homes through a right-in, right-out only intersection at Veterans Memorial Parkway which is a controlled access highway. The City Engineer, in coordination with the Ministry of Transportation and Infrastructure, has determined that a safe, second access route must be dedicated prior to adoption of the bylaw rezoning 2703, 2707, 2711 Claude Road and 726 Percy Place.

[Image 2: Subject Properties map showing Percy Place cul-de-sac and surrounding properties]

Working with the City’s Engineering Department, the applicant has demonstrated that dedicating half of the full 15m road cross section will satisfy access and safety concerns. The interim 7.5m road will allow two-way traffic with 3m wide vehicle lanes and a 1.5m shared pedestrian/bicycle pathway.

Road dedication will be required to complete the road by adding boulevards with street trees, wider travel lanes, and a wider sidewalk when the properties to the south, 733 Percy Place and 2715 Claude Road, choose to redevelop.

The applicant’s proposal meets many objectives of the Official Community Plan’s traffic reduction and multi-modal, active and alternative transportation strategies. This new connection will improve the City’s transportation network and provide better pedestrian and cycling access to the forthcoming Downtown University campus and other downtown amenities. As a condition of rezoning, the applicant has agreed to provide at least two bike parking stalls per unit complete with e-bike charging and five stalls for cargo bikes, a bike repair and wash station and two electric MODO Carshare Co-op vehicles on site along with the new road construction.

The Engineering Department has not identified any utilities located within the portion of road proposed to be closed. Notification of the intent to close the road will be delivered to utility operators prior to Bylaw adoption. If utilities are found within the area to be closed, they would be relocated as part of the project’s site servicing or a statutory right of way can be registered prior to bylaw adoption.

### FINANCIAL IMPLICATIONS
All costs associated with the road closure and disposition will be the responsibility of the applicant. In exchange for closing and disposing of 58.1m2 of Percy Place, the City will receive approximately 294.2m2 of new dedicated road.

### LEGAL IMPLICATIONS
The subject portion of Percy Place is within 800m of an arterial highway which means the road closure bylaw is subject to approval from the Ministry of Transportation and Infrastructure prior to adoption.

Public notification of the road closure and disposition is subject to s.94 of the Community Charter.

This road closure is subject to the legal requirements of s.40 of the Community Charter and s.120 of the Land Title Act.
