I am writing in support of who reside at following:
Civic Address 2038 Troon Court Legal description: Lot 5, Section 82, highland District, Plan VIP76197, PID:025-827-855

According to the bylaw:

3.01.01 Except where specifically excluded the following uses, buildings and structures are permitted in every Zone:

(1) Uses, buildings and structures which are accessory to a principal permitted use, building or structure on the same lot.

As well as:

3.03 Vehicle Storage

Zoning Bylaw No. 300 City of Langford

Except where specifically permitted, no lot with a lot area greater than or equal to 550 m2 (5,920.2 ft2) may be used for the keeping of more than one unlicensed vehicle, other than a farm vehicle or recreation vehicle, which is not completely enclosed in a building or structure; (Bylaw No. 2126)

We are in agreement with who has expressed support for the design and location of the accessory building in relation to the Bear Mountain Golf Course. As a resident of the Bear Mountain community who has a property directly adjacent to the golf course, our address being 114-1244 Murfield place which is located off the 17th green on the Mountain course. We understand the importance of trying to protect personal property from errant golf balls that leave the confines of the course. Broken windows, damage to vehicles, personal property and damage to housing structures are to name a few. The structure in questions provides the homeowner with adequate protection of their personal property and their person.

, I have noticed no difference in the aesthetics of the golf course, or the property as the shed was professionally built and is in keeping with the design and flow of the existing house and property, as well as the neighbouring properties around it.

Thank you for your time and consideration.

Sincerely
Douglas Mara

Dear Advisory Committee Meeting Members:

In regards to File No: DVP23-0007, 2038 Troon Court.

We have been put in a difficult position as we would prefer to avoid conflict with our neighbors, however, we can not support this application for the following reasons:

1. This building has negatively impacted our view from our dining room , living room, kitchen and two outdoor patio areas.
2. This is not a minor variance to the zoning bylaw, it completely defeats the intention of the bylaw “no accessory building in a rear yard”.
3. The building is not in compliance with statutory building scheme EV147576.
4. An approval in this instance would condone “build it and then get approval” syndrome.
5. The application does not meet the criteria listed in Langford’s Board of Variance policies for adjudication.

I have attached a photo which was taken from inside our house.

We have no concern with the smaller shed.

Thank you for the opportunity to provide our input.

RE: DVP23-0007

I am in support of to have applied to vary the regulations for accessory buildings within the Resort Community of Bear Mountain 1 (RCBM1) zone and the general accessory buildings regulations of Part 3 – General Regulations of Zoning Bylaw No. 300 to allow for two existing accessory buildings located at 2038 Troon Court to remain in their current locations.

Prior to constructing the building on property, took into consideration neighbour’s property south of and engaged in discussion with them (they had no issue with things at that time). The ownership of Bear Mountain Golf provided support for and in no way does the building impede the visually for anyone. As a golfer, I have driven past hundreds of times past their yard and the building is not even visible. yard is impeccable and along with have worked very hard to sustain a beautiful setting in their yard.

Also, I am aware of and has worked very hard to offer the ability to enjoy the use of a with other golfers. This entire building is there to offer security as well.

I ask the committee to review certain points as outlined:

1) During Covid, the private cart allowed additional protection as golfers were only allowed to have one person per cart. This has allowed to continue golfing with friends limiting concerns for
2) Golf carts are not licensed or allowed on public roadways and the access for personal golf carts is directly onto the golf property.
3) There are no financial or legal implications to address for Langford. However, it would affect financially if this re-zoning would not pass.
4) We have had security issues on Bear Mountain more recently and I am aware of This only offers more security for their investment.
5) This does not create a visible eye-sore to anyone in any direction.

Again, thank you for your time and consideration with this application. I am confident that the members of the committee will do the right thing.

Sincerely,
John Ellwood

Hi Barbara, I would appreciate it if you could distribute this to council in advance of the Nov 20th 7pm meeting.

Council members,

Regarding agenda item 8.2.2 – DVP - 2038 Troon Court

Thank you for the opportunity to provide our input.
We live adjacent to the applicants property and are most affected by the newly constructed garage.

Refute/clarify made at the DVP23-0007 committee meeting of Nov 14, 2023

### Public Submissions and Correspondence - Part 2 of 2

Source pages: 29–43

- The applicants reason for building in their rear yard was to access the golf course with their golf cart and the applicant states this is the only way they could do that.
  - Video time stamp 1:28:26 of Nov 14 DVP meeting: Applicant: “cannot get up our side yard” with golf cart to access the golf course.
  - I have attached a photo of the applicants side yard which shows a gravel path that accesses their rear yard from beside their 3 car garage. The side yard appears to be +/-9 feet wide. Typical golf cart width is +/-4 feet. Golf cart access to their rear yard from their 3 car garage via their side yard is feasible.

- Question from Councillor Wagner as to how long the garage has been in place. The garage was not built in 2021. It was under construction late March 2022 and the District of Langford has been addressing this issue since the beginning of April 2022. There has been no period of acceptance of this garage by ourselves & construction was very rapid.

- There was discussion about vegetation screening. The eave of this building is 0.36m from the property line so the applicant has little opportunity to use vegetation on their property to screen it from us. It was suggested that our vegetation partially screens it. Our small maple tree by the applicants garage is dying and the leaves typically fall in October and are not full again until May/June. A vegetation screen does not address our main concern, which is that we lost a view corridor of the golf course from all of our primary living areas due to an illegal 14 foot long roof.

Building size & permit:
- The survey plan shows the garage to be 12’ x 12’. The building is about 12‘ high & the roof pitch is steeper than need be. Given the typical golf cart size of approximately 4’ x 8’ x 6’ high, we see no evidence that the applicant attempted to minimize the building size or visual impact on us. The garage is 142 sq. ft so we believe a building permit is required as it is larger than 107sq.ft. This is at odds with the commentary section of the DVP that a building permit was not required.

Precedence:
- In our review of aerial photos, we can not find any accessory buildings in any rear yards of the golf course lots indicating an overall awareness of the by-laws and that no variances/permits have been granted in these circumstances for decades.

Impacts on 2044 Troon Court:
- This garage has impacted our view from our dining room, living room, kitchen and two outdoor patio areas. It has blocked previous views we had down the golf course from all of our primary living areas. Our house is higher in elevation than the applicants. We see over top of our bamboo at the property line. We have attached photos taken from our property.

Langford by-law 300 Section 6.95.05:
- This by-law prohibits accessory building anywhere in the rear yard of golf course lots.

Local Government Act:
We have highlighted applicable sections of the Local Government Act Sec. 542 (1)(c ):

542 (1)On an application under section 540, the board of variance may order that a minor variance be permitted from the requirements of the applicable bylaw, or that the applicant be exempted from section 531 (1) [alteration or addition while non-conforming use continued], if the board of variance
(c)is of the opinion that the variance or exemption does not do any of the following:
(i)result in inappropriate development of the site;
(iii)substantially affect the use and enjoyment of adjacent land;
(v)defeat the intent of the bylaw;

Langford by-law 6.95.05 prohibits accessory building in the rear yard so we believe an approval of this application would defeat the intent of by-law 6.95.05 as well as not being a minor variation to it.

Possible solution:
- We could support an application if the applicant went to a flat roof and lowest possible building height to contain a golf cart so that our views could be partially restored however, council may still not be able to grant a variance which would have the effect of striking out by-law 6.95.05 for one lot. It appears the Local Government Act would prevent effectively striking out a by-law for an individual lot by way of variance.

Respectfully submitted,
Jason & Cathy Kozina

Name: William Colin Coughlin
Address: 2049 Troon Court, Langford, V9B 6R6

Unfortunately I will not be able to attend the meeting on Dec 4 due to prior commitments.

Question: Why is there inconsistency in the enforcement of the by-law/covenant?

Context: I am a neighbour of the subject property
I have no concern with their placement. I note that many other properties in this area are non-compliant with local area by-laws/covenants (fences, RVs, etc), thus I need to deduce that the issue with 2038 Troon is based solely on a local resident complaint and not on any form of municipal oversight. Based on the report on the Langford web site, the golf course has also not had any issues with the subject property's placement of their sheds. I fully understand that we need to preserve some form of neighbourhood structure and do not want to ignore all local rules and create a free for all. Having said that, we need to consider the spirit of the rule rather than the exact wording. An eleven inch breach, with all structures still within the properties property line is a very minor issue. This neighbourhood is facing much more significant issues with the construction of One Bear Mountain nearing completion. We are all worried about traffic flow and parking. I think it is time to revisit all local by-laws in light of the area's growth and not to impose a sanction on an existing neighbour's infraction.
