5.1 BYLAW NO. 2098

"Langford Zoning Bylaw, Amendment No. 692, (2833, 2835, 2837, and 2839 Knotty Pine Road) Bylaw No. 2098, 2022."

The Mayor opened the Public Hearing for Bylaw No. 2098 at 8:08 p.m.

Director of Planning Matthew Baldwin advised that Alex Gannochka of ADEPT Engineering Ltd. has applied on behalf of 829 Development Group Ltd. to rezone 2822, 2835, 2837, and 2839 Knotty Pine Road from the One- and Two-Family Residential (R2) Zone to the City Centre 2 (CC2) Zone.

This is being proposed in order to allow for the development of a townhouse project with approximately 26 units.

Prior to Public Hearing, Council required the following items:

  1. A technical memo from an engineer that verifies stormwater can be adequately managed on-site for the proposed developments, to the satisfaction of the Director of Engineering;
  2. A memo prepared by a Landscape Architect that examines existing trees on site and in the frontage and provides comment on the potential for tree retention as part of the development plan, to the satisfaction of the Director of Planning;
  3. A revised site plan to the satisfaction of the Director of Planning;

The above items have all been completed and were considered and accepted by Council during their meeting held on February 6th, 2023. The revised site plan allows for three existing trees to be maintained and includes a dedication of 5% of the lot to the City.

In further support of this application, the applicant has agreed to provide the following:

  1. That the applicant will provide the following contributions per unit, prior to the issuance of a building permit:

    1. $1,000 towards the Affordable Housing Reserve Fund; and
    2. $3,800 towards the General Amenity Reserve Fund.
  2. That the applicant provides, prior to Bylaw Adoption, a Section 219 covenant, registered in priority of all other charges on that title, that agrees: a. That the following be implemented to Bylaw No. 1000 standards to the satisfaction of the Director of Engineering prior to the issuance of a building permit:

    1. Full frontage improvements, inclusive of sidewalks, bike lanes, road edge parking, streetlighting, and boulevard upgrades; and
    2. A storm water management plan. b. That a Construction Park and Traffic Management Plan be provided to the satisfaction of the Director of Engineering prior to any alteration of land; c. That the four subject properties be consolidated prior to the issuance of a Development Permit for Form and Character; d. That a separate covenant be registered agreeing that the garages and carports are to be used for the parking of vehicles and not the storage of items preventing the parking of vehicles therein. e. That all concrete used on-site will be produced using post-industrial CO2 mineralization technology, or equivalent which offers concrete with lower embodied CO2 than all other competing bids, and that prior to the issuance of a Building Permit the applicant shall provide a product-specific Type III Environmental Product Declaration that is 3rd party verified specifying the total embodied carbon content of concrete. f. That 5% of the lot area be dedicated to the City at the southwest corner of the lot, inclusive of the Garry Oak and Bigleaf Maple trees, prior to the issuance of a building permit; g. That the tree protection measures outlined in the arborist report be implemented throughout construction to protect the Garry Oak, Bigleaf Maple, and Cypress trees that have retention potential, inclusive of tree protection fencing.

This proposal is consistent with the Official Community Plan City Centre designation. Notifications and advertisements have been placed as required by the Local Government Act.
