### BACKGROUND
In the spring of 2021, Council directed staff to establish a new cultural district, The Langford Station, on lands being leased from the Island Corridor Foundation (ICF). This cultural district includes a public plaza with artist studios, business incubators, food truck stalls, a rentable workshop, and a covered area for entertainment purposes.

The artist studios and business incubators are rented out on an annual basis, however business incubators may be extended should the City and lessee agree to terms.

Pursuant to the Community Charter, fees for municipal services may be charged by bylaw. Therefore, staff brought forward the initial Fees and Charges Bylaw last year. The Langford Station has been in operation for a year and staff have had an opportunity to confer with both the artists and businesses with respect to how things are working. As a result of this consultation, staff believe that the fees and charges pertaining to The Langford Station should be adjusted.

### COMMENTARY
Under section 194 of the Community Charter, Council may, by bylaw, impose a fee payable in respect of a service of the municipality and the use of municipal property. While staff initially believed that the Fees and Charges imposed under the original bylaw would be sufficient for the first year, staff is now recommending changes based on the actual operations. A summary of the changes is as follows:

- Creation of a new category and rate to allow businesses to occupy the ten foot containers as well as the twenty foot containers;
- Adjustment to the deposit amount for use of the “Creation Station” to make it more affordable for small groups and not for profit organizations to rent it;
- Discounted user rate for the Creation Station for not for profit organizations;
- Changes to verbiage in the table to ensure clarity and consistency; and
- Changes to the Food Truck fees to allow for flexibility for special event pricing.

These proposed changes allow for more flexibility in tenants and fee categories that will accommodate a variety of business models in the smaller units that were previously intended to only allow artists. Staff will continue to review these fees and charges on an annual basis and bring forward recommendations to Council to update them when needed to ensure fair and competitive market value.

### FINANCIAL IMPLICATIONS
The revenues generated will be collected by the City and will be used to offset costs incurred including staff time, administration and costs associated with the operation of The Langford Station.

### LEGAL IMPLICATIONS
None.

### OPTIONS (Staff recommendations verbatim)

Option 1
THAT Council give first, second and third reading to Bylaw 2119.

OR Option 2
THAT Council take no action regarding the proposed fees and charges amendment.
