## Staff Report to Council

### DATE: Monday, March 21, 2022
### DEPARTMENT: Planning
### SUBJECT: Bylaw 2054 - EV Charging in New Developments

### BACKGROUND:

On December 6, 2021, Council passed the following resolution with respect to Electric Vehicle ("EV") charging in new developments:

1. Direct staff to prepare a bylaw that amends the Design Guidelines such that:

   a. For all new multi-family buildings, electric vehicle parking spaces shall be provided with an energized outlet capable of providing Level 2 charging or higher to the parking space, with the total number dependent on the type of development, location and the agreed upon ratio of EV stations required.

Following Council’s resolution, staff were notified by our legal team that imposing conditions for “EV” charging on private developments by means of a stand-alone policy, design guideline or development permit area is likely unenforceable and beyond the scope of local government authority.

The City’s legal team advised that the best form of implementation was through an amendment to Zoning Bylaw 300 pursuant to the City’s authority under section 525 (Off-Street Parking and Loading Space Requirements) of the Local Government Act.

The conditions presented within proposed Bylaw No. 2054 (attached) are based on best practices for future proofing developments for “EV” charging. In addition, each recommendation is consistent with the implementation methods provided by other municipalities with EV charging requirements.

It is noted for Council’s reference that the details of this bylaw were provided to developers and the public prior to the December 6, 2021 meeting.

If Council supports this change, they may wish to give first reading to Bylaw 2054 as drafted.

   b. Energized outlets, provided pursuant to section (1) above, shall be labelled for the use of electric vehicle charging;

   c. Where EV charging is required, the following must be included at the time of building permit application:

      i. A site plan that shows the location, number and specifications of all energized parking spaces; and

      ii. A memo from an electrical engineer that verifies that the load capacity of the building can provide L2 EV charging to all residential stalls;

   d. Where an Electric Vehicle Management system (“EVMS”) is required, an electrical engineer shall verify that Level 2 charging can achieve at least 12kWh per vehicle over an eight-hour period when all vehicles are charging simultaneously;

   e. Where an EVMS is employed, the owner shall:

      i. Ensure all necessary permits, authorizations and variances under the Safety Standards Act, SBC 2003, c. 39, and the Electrical Safety Regulation, BC Reg. 50/2017, have been obtained for the installation and operation of the EVEMS, prior to occupancy permit;

      ii. provide and install all communications equipment, control systems, and other services required to operate the EVMS;

   f. Where an EVMS is implemented, the developer shall install all communications equipment, control systems, and other devices required to operate the EVEMS and include a covenant that requires the strata to maintain the EVMS in perpetuity;

   g. Prior to occupancy permit, the owner shall provide a compliance form certified by a registered professional or qualified electrician, confirming that the energized spaces, and equipment meet the requirements of the zoning bylaw;

   h. Where load sharing is implemented, the maximum number of stalls connected to the same circuit in the building, for various circuit ratings, is as shown in Table 1 below:
