Committee Terms of Reference

### Background

## Background

Dating back to 1994, the City has created advisory committees comprised of both Councillors and members of the public. These committees play an important role by providing Council with constituent input. An original terms of reference document for the committees was drafted in 1994, and in 2008, individual terms of reference for each committee were created. As part of a wider ongoing review of the City’s policies and procedures, staff have been working on revising the Terms of Reference since the summer and the attached document presented today represents a review and re-write of the existing individual terms of reference to align with best practices and the City’s current committee structure.

## Commentary

Langford has five regular committees – Finance and Administration, Planning Zoning and Affordable Housing, Transportation and Public Works, Parks and Recreation and Protective Services. These committees are comprised of a combination of elected officials, two per committee, and members of the public.

Vacancies on these committees are open to the public to apply, advertisements are placed in the local paper to announce the opening. Council then reviews the applicants, with input from staff, and determines who will sit for that term. The members generally sit for a term equal to that of the councillors, four years, although interim vacancies are filled at council’s discretion. The Chair and Vice-Chair roles are occupied by elected officials, provisions have been added for appointment of alternates in the event the Chair or Vice Chair are unable to attend.

The frequency with which a committee meets varies; PZAH meets the week prior to a Council meeting, other committees are less frequent. It is important to note that these Committees are purely advisory in nature, Council has not delegated any powers, duties or functions to these committees. Therefore, while they may make recommendations to Council, the authority for any decision related to the matter is left to Council’s discretion.

While the changes to the Terms of Reference are not significant, revising them provides an opportunity to adapt the terms to current practices.

Further, the City documentation, both in our policies and on our website, have referred to these committees as “Standing Committees”. Standing Committees are a specific type of body, the composition of which is set out in the Community Charter as being comprised of a majority of council members and as being constituted by the Mayor. Upon review, that description does not apply to the structure of the committees mentioned above and are corrected with these new terms of reference.

In addition, there will be a single document to apply to all of the committees, ensuring consistency with respect all committees and allowing for a simplified process to update the terms should it be necessary.
