Subject:
Rugby Canada Lease of Office Building Located at 3024 Glen Lake Road

### Background
Council may be aware that the City of Langford entered into a 15 year Lease with Rugby Canada for the Office Building located at 3024 Glen Lake Road in January 2012. This lease also includes 6 storage lockers on the lower level of this building, use of the commercial washer and dryer on the lower floor, use of the Eagle Ridge Training Centre, and use of the City’s suite in the Stadium. The use of the City Suite and Eagle Ridge Centre was no longer required after Rugby Canada took possession the Al Charron – Rugby Canada National Training Centre in 2017.

In 2015, Council approved a partnership with Rugby Canada and the Federal Government through an Infrastructure Grant, to build the Al Charron - Rugby Canada National Training Centre at 3019 Glen Lake Road. In 2018, Rugby Canada centralized their administration functions across the country to the City of Langford. Over the past two years Rugby Canada has continued to occupy both buildings, but have found they have excess space that is not utilized to its full potential. In 2019, Pacific FC has subleased spaces in the Al Charron - Rugby Canada National Training Centre for player rehabilitation and staff administration space in the area allocated for the future home of the Rugby Canada Hall of Fame.

### Commentary
In March 2020, with the onset of COVID-19, Rugby Canada approached City staff with a proposal to sub-lease the office space located at 3024 Glen Lake Road to Pacific FC, who are looking for suitable office space in Langford. On June 1, 2020, the City received the attached letter from Rugby Canada with a formal request to terminate the Lease Agreement. This would allow the City to enter into a new lease agreement with Pacific FC for the space. Rugby Canada has requested a new lease agreement for continued use of the six lockers and non-exclusive use of the commercial laundry space on the bottom floor of the building (the latter of which would be shared with PFC).

### Financial Implications
Under the proposed lease agreement with Pacific FC for a market rate monthly lease, payment will be $5750.00, less protections and termination clauses as they pertain to COVID-19. Rugby Canada will lease the six storage lockers for $200.00 per month for a total of $1200.00 per month.

### Legal Implications
All leases would be / have been prepared in consultation with City lawyers. Notices, as required by the Community Charter, have been placed in the newspaper.

### Options

1. That Council:
   a.
Approve the termination of the lease with Rugby Canada for the office space located at 3024 Glen Lake Road; and
   b.
Approve the City Administrative Officer (CAO) to negotiate a three-year lease agreement with Pacific FC at the current market rate of 23 sq. ft. for the office space located at 3024 Glen Lake Road and authorize the Mayor and CAO to execute the lease agreement; and
   c.
Approve the CAO to negotiate a two-year lease agreement with Rugby Canada at the current market rate, for six storage lockers located on the lower floor of the office building located at 3024 Glen Lake Road and authorize the Mayor and CAO to execute the lease agreement; or

2. Council decide to take no action at this time.

RE: Rugby Canada Lease of 3024 Glen Lake Road (Centre of Excellence Building)

Mayor Young:

Thank you & council for the City of Langford’s continued support of Rugby Canada. We and our National Team Athletes are incredibly proud to call Langford our home!

I am writing to request the City of Langford’s assistance in terminating the Lease Agreement, dated 01-January-2012 for the Centre of Excellence office building, located at 3024 Glen Lake Road.

Due to a streamlining of our operational staff & the ability to locate all staff in the Al Charron National Training Centre building, located at 3019 Glen Lake Road, we no longer require the office space on the second floor of the “Office Building”, as defined in the Lease Agreement. We further understand this will assist the City of Langford in their support of the Pacific FC football club’s operations, which Rugby Canada fully supports.

Rugby Canada requests a new lease/rental agreement be established to permit Rugby Canada’s continued use of the existing locker spaces, the non-exclusive use of the laundry facilities located in the storage area of the “Office Building” & the Field Use, as detailed in Schedule F of the current Lease Agreement.

We greatly appreciate Council’s consideration of this request.

Sincerely,

Allen Vansen
Chief Executive Officer

CC
Tim Powers, Chairman – Rugby Canada

Darren Kiedyk, CAO – City of Langford
