Subject
Delegated Public Hearings held May 25th, 2020
Background
Council, at its regular meeting of April 6th, 2020, delegated the authority to convene Public Hearings to Councillor Denise Blackwell, for all applications for rezoning that were not consistent with the Official Community Plan, and thereby could not be waived by Council.
On Monday, May 25th at 5:30pm, Public Hearings were convened for the following applications:
- “Langford Official Community Plan Bylaw, Amendment No. 33, (Text Amendment – Regional Context Statement), Bylaw No. 1862, 2020";
- “Langford Official Community Plan Bylaw, Amendment No. 35, (4342 West Shore Pkwy and 1324 Langshire Rd), Bylaw No. 1887, 2020";
- “Langford Zoning Bylaw, Amendment No. 584, (4342 West Shore Pkwy and 1324 Langshire Rd), Bylaw No. 1888, 2020";
- “Langford Official Community Plan Bylaw, Amendment No. 36, (1336 Langshire Rd), Bylaw No. 1889, 2020".
- “Langford Zoning Bylaw, Amendment No. 585, (1336 Langshire Rd), Bylaw No. 1890, 2020".
Commentary
All three public hearings were convened by the Chair, and the specifics of each application was introduced by the City Planner in a manner similar to all other Public Hearings held in Langford.
The Chair called three times for input from the public, and as no one stepped forward to speak, each Public Hearing was duly closed.
Financial Implications
Rezoning applications include a Public Hearing fee which represents cost recovery.
Legal Implications
The City is obligated under Sec. 464 (1) to conduct a Public Hearing with respect to a bylaw amending either the Official Community Plan or Zoning Bylaw (where the bylaw is not consistent with the OCP).
Options
That Council receive the report of its Delegate with respect to the Public Hearings for Bylaws 1862, 1887, 1888, 1889 and 1890;
That Council not receive the report of its Delegate with respect to Public Hearings, and direct staff to convene a second Public Hearing for Bylaws 1862, 1887, 1888, 1889 and 1890;
Respectfully submitted,
