### Staff Report to Council

Date:
May 21, 2019

Department:
Planning

Subject:
Bylaw No. 1851 - Application to make various amendments to the text within the RS3 zone for the property located at 939 Walfred Road.

### Background
As part of the application to rezone 939 Walfred Rd (Z18-0016), a number of proposed amendments to the RS3 (Residential Small Lot 3) Zone for the subject property were endorsed by Council. However, several of these amendments were inadvertently excluded from the body of the amending bylaw (Bylaw No. 1826), which has passed Public Hearing and is currently under consideration for Bylaw Adoption.

### Commentary
Bylaw No. 1851 has been prepared for Council’s consideration to implement these further amendments, which include the following in accordance with Council’s resolution of February 4th, 2019:

….amend the text within the RS3 zone for the subject property such that:

a) Secondary suites are permitted, in accordance with section 3.08, on all lots larger than 400 m2 with a lot width greater than 12 m;
b) The total floor area of the of one family-dwelling on lots less than 400 m2 may not exceed the total area of the lots they occupy (e.g. 1.0 FSR);
c) The minimum lot size is reduced to 200 m2.

Council may wish to give Bylaw No. 1851 First Reading in conjunction with the adoption of Bylaw No. 1826, as they form part of the same development proposal.
It is noted for Council’s reference that all conditions of Z18-0016 were reviewed by the Planning, Zoning and Affordable Housing Committee, Council and the Public throughout the rezoning process for 939 Walfred Rd. As such, Council may wish to waive the requirement for a Public Hearing for this Bylaw.

### Options

That Council:

1. Give 1st reading to Bylaw No. 1851.

AND
2. That Council waive the requirement for a Public Hearing with respect to Bylaw 1851;

OR

Take no action at this time with respect to Bylaw No. 1851.
