Planning

### Application No.:
Z19-0003

### Subject:
Bylaw No. 1832- Application to amend the text within the C3 (District Commercial) Zone to allow a general industrial use at the property located at 1016 McCallum Road

At the Regular Meeting of Council on February 19, 2019, Council gave Bylaw No. 1832 First Reading.

### COMMENTS

Bylaw No.1832 is a text amendment to the C3, District Commercial, Zone to allow a sheet metal fabrication and laser cutting business to operate at 1016 McCallum Road. The Staff Report submitted with the proposal recommended that Council to request the registration of a Section 219 Covenant on the property that would restrict the operation of the general industrial use within a commercial zone. Despite the reference to requiring the Section 219 Covenant, there was no resolution associated with First Reading of Bylaw No. 1832 and the opportunity to secure a Covenant was not realized.

If Council is supportive they may wish to add to Bylaw No.1832 a resolution that states the following:

a) That the applicant provides, Prior to Bylaw Adoption, a Section 219 Covenant, registered in priority of all other charges on title, that agrees to the following:

i. That there shall be no unenclosed storage associated with a general industrial use, despite regulations that allow unenclosed storage within the C3, Commercial District, Zone;

ii. That any activities associated with a general industrial use be conducted within the unit of operation, and all other potential nuisances, including but not limited to: noise, odour, dust or vibrations be limited so as to not be discernible beyond the walls of the unit.

### OPTIONS:

That Council:

1. Give Second Reading to Bylaw No.1832 subject to the following terms and conditions:

   a) That the applicant provides, Prior to Bylaw Adoption, a Section 219 Covenant, registered in priority of all other charges on title, that agrees to the following:

   i. That there shall be no unenclosed storage associated with a general industrial use, despite regulations that allow unenclosed storage within the C3, Commercial District, Zone;

   ii. That any activities associated with a general industrial use be conducted within the unit of operation, and all other potential nuisances, including but not limited to: noise, odour, dust or vibrations be limited so as to not be discernible beyond the walls of the unit.

   Or

2. Give Second Reading to Bylaw No.1832 as is, with no resolution.
