## BYLAW NO. 1833 – Langford Zoning Bylaw, Amendment No. 559 (790 McCallum Rd) (First Reading)

### Staff Report to Council

Date: March 4, 2019
Department: Planning
Application No.: Z19-0004
Subject: Bylaw No. 1833 - Application to Amend the Text of the MUE2 Zone to Allow Gasoline Service Stations

### Purpose

Source pages: 149–153

## Purpose

Niall Paltiel of Keycorp Consulting as applied on behalf of 1054105 BC Ltd. (Seacliff Properties) for a text amendment to the MUE2 zone (790 McCallum Road) in order to permit Gasoline Service Station as a permitted use.

### Background

Source pages: 149–153

## Background

On February 19, 2018 Council adopted an OCP amendment and rezoning of 790 McCallum Road. The amendment changed the designation of the property from ‘Neighbourhood’ to ‘Mixed Use Employment Centre’ and the rezoning was changed from CH1 (Cluster Housing Residential) to MUE2 (Mixed-Use Employment 2).

### Commentary

Source pages: 149–153

## Commentary

The original rezoning did not contemplate a ‘Gasoline Service Station’ as a permitted use. However, one of the potential purchasers of one of the lots being created wishes to construct a gasoline service station and use the remaining portion of that site as surface parking. This text amendment would just add ‘Gasoline Service Station’ as a permitted use as ‘Parking Facilities’ is already a permitted use, and the amendment would be added to the entire parent property in the event that more than one service station is planned for this area.

### Frontage Improvements
Typically, frontage improvements are a requirement of a rezoning. However, in this case the frontage improvements have already been contemplated and secured in the original rezoning (Z17-0037) of this property that changed the zone to MUE2. No additional frontage improvements are required with this rezoning.

### Financial Implications

Source pages: 149–153

## Financial Implications

The individual parcel that is being contemplated for a gasoline service station and parking lot is just over 2 hectares ( 5 acres ) in size. Council may not consider this to be the best use of this much land in the Mixed Use Employment Centre zone. However, in supporting this application Council may request that additional landscaping be installed on the site, above and beyond what our current guidelines require in order to mitigate the look of an open parking lot of this size along McCallum Road.

### Options

Source pages: 149–153

## Options

That Council:

1. Direct the Director of Planning to require additional landscaping above and beyond what the current guidelines require for lands within the MUE2 zone that are developed for a Gasoline Service Station and/or Parking Facilitates.
AND
2. Give 1st reading to Bylaw No. 1833.

OR

3. Take no action at this time with respect to Bylaw No. 1833.
