Staff Report (Planning) — Add an Item to the Required Covenant for Rezoning of 887 Klahanie Drive
Date
January 21, 2019
Department
Planning
Application
Z18-0002
Subject
Add an Item to the Required Covenant for Rezoning of 887 Klahanie Drive
Background
The rezoning application Z18-0002 for 887 Klahanie Drive went the Planning, Zoning and Affordable Housing Committee on November 6, 2018 and received 1st reading of the bylaw from Council on December 3rd, 2018. This application is now before Council on this date, January 21 for 2nd and 3rd readings.
Commentary
After receiving 1st reading, neighbouring property owners approached the City and requested that this development provide access to lands to the south. This is not an unreasonable request, but requires working with the current developers of 887 Klahanie to achieve this in a fair and reasonable manner as the road being built on 887 Klahanie will be a private strata road. This can be worked out in a variety of ways, which would need to be secured prior to adoption if Council wishes to add this item to the resolution of the rezoning application for 887 Klahanie Drive.
Financial Implications
There are no known financial implications for the City regarding this additional item for the covenant.
Legal Implications
There are no known legal implications for the City regarding this additional item for the covenant.
Options
Option 1
That Council:
- Add the following item to the covenant that is to be registered prior to adoption of the rezoning application for 887 Klahanie Drive: a) That lands to the south of 887 Klahanie Drive have the legal ability to access the first portion of the strata road being proposed on this development site in order to provide access for future developments to the south.
OR
Option 2
- Take no action at this time and not add a requirement for the development of 887 Klahanie Drive to provide access to lands to the south.
