Date: August 20, 2018
Department: Parks & Recreation

### Background
In 2013, a five-year agreement was drawn up between the City of Langford and Janette Roch, owner of Shoreview Gateway Bed and Breakfast. The agreement allowed the Business Owner to use a portion of Park land located at 3041 Shoreview Drive as a footpath right-of-way to an existing boardwalk and dock, which is associated with her Bed and Breakfast located at 3037 Shoreview Drive.

### Commentary
The five-year agreement expires on October 1, 2018 and Ms. Roch would like to renew this agreement for another five years.

The foot trail access to the dock/boardwalk is through the City’s undeveloped Park. The area of the park affected by the trail is approximately 255 m2. In 2013, the calculated property taxes on this area of land were approximately $200/year. Ms. Roch pays the City $200/yearly to maintain access to her dock via an easement.

### Financial Implications
There are no financial implications.

### Legal Implications
Ms. Roch has agreed to take out $5 million insurance policy with the City named as ‘an Additional Insured’.

### Options
That Council:
1. Renew the agreement for a period of five years with the registered owner of 3037 Shoreview Drive and collect a fee of $200/year;
or
2. Do not grant an easement with the registered owner of 3037 Shoreview Drive to access City property.
