### b) BYLAW NO. 1782
"Langford Zoning Bylaw, Amendment No. 536, (832 Hockley Ave), 2018".

- The Mayor opened the Public Hearing for Bylaw No. 1782 at 5:33 p.m.
- Mayor Young advised members of the audience on opportunity to be heard and the public hearing procedure.

The City Planner advised that Niaii Paltiel of Keycorp Planning Ltd. has applied on behalf of NAiX Ventures Ltd. to amend the zoning of 832 Hockley Avenue from the R1 (One-Family Residential) Zone to the MUIA (Mixed Residential Commercial 1) Zone.

This is being proposed in order to accommodate the construction of a 6 storey residential building that is proposed to be constructed on the subject property and on the adjacent property located at 828 Hockley Avenue.

On April 16, 2018, Council adopted a new Affordable Housing and Amenity Contribution Policy. This new policy provides a 50% reduction in amenity contribution for the 5th and 6th storeys of any market multi storey building, as an incentive for building higher buildings. This reduction was not reflected in the report that was prepared for Council's Planning and Zoning Committee on May 14, 2018, and therefore did not find its way into Bylaw No. 1782 when it was prepared. The applicant has requested that Council new policy, not the previous one, be applied to this application. Bylaw No. 1782 has been amended, and has been provided for Council's consideration.

Should Council wish to proceed with this rezoning, they may amend Bylaw 1782 at first reading and give Bylaw 1782 second and third reading following the conclusion of this Public Hearing.

In support of this application, the applicant has agreed to provide the following contributions in accordance with Council's Affordable Housing and Amenity Contribution policy:
- $2850 per dwelling unit towards the General Amenity Reserve Fund for any units up to and including the 4th storey;
- $1425 per dwelling unit towards the General Amenity Reserve Fund for any dwelling units on the 5th and 6th storey; and
- $712.50 per dwelling unit for any dwelling unit above the 6th storey; and

All of these contributions to the General Amenity Reserve Fund shall be reduced by the cost of extending the sidewalk to Peatt Road, beyond the property frontage.

In addition to this General Amenity contribution, the applicant has also agreed to provide:
- $750 per unit towards the Affordable Housing Reserve Fund;

This proposal is consistent with the Official Community Plan City Centre designation. Notifications and advertisements have been placed as required by Council policy.

- The Mayor called a first time for presentations. None.
- Mayor Young called a second time for presentations.
  - Resident on Hockley Ave wanted to know setbacks on property and clarified that if there are limited setbacks he wants fence looked after and wants arborist to minimize damage to trees.
  - Matthew Baldwin clarified that in addition to setbacks building code ensures appropriate distances between buildings.
  - Him Hartshorne, Developer noted that the building will be setback 7 meters.
  - Resident who lives at rear of building asked about maintenance of large trees.
  - Jim Hartshorne said that an arborist would look at tree but likely cut down.
- The Mayor called a third and final time for presentation, there being none, the Mayor officially declared the Public Hearing for Bylaw No. 1782 closed at 5:44 p.m.
