Subject: Westshore Rebels Request for Liquor Licence Decommissioning
Background
The Westshore Rebels have operated out of Westhill’s Stadium since the opening of the facility in 2009. When the facility was initially opened the Rebels had a cost-sharing arrangement with Performance Plus (PP) for advertising and food and beverage services. This helped to cover the Rebels’ operational costs. In recent years, advertising has fallen off resulting in little or no profit sharing of advertising and Performance Plus costs to operate the concession and liquor have reduced or eliminated any revenue that the Rebels previously received from food and beverage sales.
When the Stadium was built, the City designed the concession so that local groups and teams could operate the food and beverage and recover some of their club’s ongoing costs. Some of the organizations have used this option however this is the first request from an organization to oversee the sale of liquor for their entire season.
Commentary
The City holds the Primary Liquor license for the stadium and Performance Plus is named as the Third Party Operator. Performance Plus is under contract with the City to operate the Stadium. Staff have communicated with PP who have expressed concern over liability and food safe requirements. The Rebel’s organization has confirmed that these obligations will be met so that there are no incidents.
The Rebels have applied to the City of Langford (Attachment A) to oversee the food/beverage (including liquor) for the five (5) regular season home games and the potential of an additional three (3) playoff games. The Rebels would apply to the BC Liquor Control Board (BCLCB) for a temporary suspension of the City’s Primary Licence during the Rebel’s games. The Rebels would then apply to the BCLCB for a Special Liquor License for each game. After the game, the City’s Primary Licence would come back into force.
Under this new arrangement the Rebels would receive 100% of the profit from liquor sales and share 20% with the City. The Rebels would receive a profit share of 20% from the food vendors and from this pay the City a 10% royalty. The Rebels would control security thus reducing the risk to the third party operator.
Financial Implications
The City currently receives 10% of the revenue from PP. Under the new arrangement the City would receive 20% from liquor sales and a 10% royalty from the food vendor sales.
Legal Implications
Westshore Rebels carry $5M liability insurance naming the City of Langford and Performance Plus as “Additional Insurered” (Attachments B and C). The City could require a damage deposit from the Rebels to ensure damages are repaired and additional costs are not paid by the City.
Options
That Council:
allow the Rebels to operate the food and beverage, including liquor, for the 2017 season provided they acquire the appropriate licencing from BCLCB and cover all costs associated with the licensing and de-licencing of the City’s Primary Licence for Westhills Stadium
Inform the Liquor Control and Licensing Branch that the City of Langford has no objection to the granting of this liquor license;
and,
- require a damage deposit of $1000.00 to be paid to the City of Langford prior to the first regular season game and returned to the Rebels at the end of the season provided there are no outstanding damages or additional charges.
or,
- deny the request by the Westshore Rebels as per their letter of June 19, 2017, at this time.

RE: DELICENSE OF WESTHILLS STADIUM AND CONCESSSION SERVICES
Dear Stew & Councillors,
The Westshore Rebels are seeking City support to delicense Westhills Stadium for the five (5) regular season home games with the potential of an additional three (3) playoff games. If this application is proven acceptable, the Westshore Rebels are willing to introduce profit share to the City of 20% which I understand is 10% increase from current profit share's with other groups.
We would also seek approval from council to manage concession services by using food trucks. The present outside food vendor agreement with City Centre Park has a 15% profit share back to CCP. We would seek to submit our own outside food vendor agreement increasing the profit share from 15% to 20% redirecting the profit share back to the Westshore Rebels with a 10% royalty back to the City.
At one time the Westshore Rebels received from the third party operator profit share from Food & Beverage service along with advertising revenue share. These would provide much needed financial support to the program; however, with the removal of food and beverage profit share and the loss of advertising revenue share, the program finds itself looking for creative ways to recoup this financial stream and assist in offsetting rising operational costs.
Your consideration of this request is truly appreciated. My volunteer staff and I are available to meet with your officials to discuss the details of this request.
Yours Truly,
Westshore Rebels
Rob Lervold
President

Industry standard for high risk events present 1:50 — 1:100 ratio, mid-level events 1:200- 1:300 ratio, low risk 1:400. The Rebels fall within the mid-level risk assessment.
History
Under the current stadium fee for ticketed events with liquor service includes two (2) security guards for liquor service. For any additional guards it falls on the renter to request and bare the financial cost of the additional guards. No profit share is obtained. Last season the game held between the Rebels vs VI Raiders resulted in a player being assaulted with coffee by a patron. In preparation for this game, the...

During the game leading up to the incident the Director of Game Day observed the security guard continue to disappear and fail to monitor the section adequately and when in position paid more attention to the game or conversation with a person known to him. After several requests for security to stay in position and to keep both Rebel and Raider fans off the fence, the direction was ignored.
