### Staff Report to Planning, Zoning and Affordable Housing Committee - Part 1 of 2

## Staff Report to Planning, Zoning and Affordable Housing Committee

Date: April 10, 2017
Department: Planning
Application No.: Z17-0003

Subject: Application to Amend the Text of the R2 (One- and Two-Family Residential) Zone to allow a Secondary Suite in an Accessory Building at 3039 Glen Lake Road

### PURPOSE
Fred Besel has applied to amend the text of the R2 (One- and Two-Family Residential) Zone to allow a secondary suite in an accessory building at 3039 Glen Lake Road.

### BACKGROUND
The applicant had initially proposed attaching the accessory building in accordance with Section 3.05.01 (2) below, but given length of the breezeway attachment (11m long) this would not conform to Section 3.08.03 (2) of the Zoning Bylaw which states: The secondary suite is not obtrusive so as to change the one-family nature of the one-family dwelling. As a result, the applicant has proposed to amend the text of the R2 zone to allow for a secondary suite in an accessory building.

Subsection 3.05.01(2) of Zoning Bylaw No. 300:
Where an accessory building is attached to a principal building by a wall, or a floor, or a foundation and a roof element with a width equal to, or greater than 10% of the perimeter dimension of the small structure, it is considered a part of the principal building and must comply in all respects with the requirements of this Bylaw applicable to the principal building.

| OCP Designation | Existing: Hillside and Shoreline Proposed: Hillside and Shoreline |

### SITE AND SURROUNDING AREA
The subject site is located on Glen Lake Road, near the entrance to Belmont school. The site is approximately 786 m2 in area and currently contains a one-family dwelling and a detached accessory building and the lot is serviced by a septic system. The surrounding area contains primarily low density residential development within the R2 (One- and Two-Family Residential).

### Table 2: Surrounding Land Uses

| Direction | Zoning | Use |
|---|---:|---|
| North | One- and Two-Family Residential (R2) and CD3 (Westhills) | Residential dwellings |
| East | One- and Two-Family Residential (R2) | Residential dwellings |
| South | One- and Two-Family Residential (R2) | Residential dwellings |
| West | One- and Two-Family Residential (R2) | Residential dwellings |

### COUNCIL POLICY

#### OFFICIAL COMMUNITY PLAN
The subject site is designated as Hillside and Shoreline within the City of Langford’s Official Community Plan (OCP) Bylaw No. 1200. The Hillside and Shoreline designation applies to existing settled areas throughout the City, predominantly on the valley floor, and is intended to:

- Predominantly existing low intensity settled areas throughout community with a high percentage of open space and undeveloped areas located on a hillside or near the shoreline.
- Predominantly residential precinct that supports a range of clustered (See Glossary & next page) low, medium and high density housing choices including secondary suites. Higher building forms, such as point towers, will be permitted on hillsides to maximize open space provided some conditions are satisfied (see policies for this area)
- Schools, community facilities and other institutional uses are permitted throughout the area
- Home-based businesses, live-work housing is encouraged; Home-based accommodations (e.g. Bed & Breakfasts) are permitted.
- Parks, open spaces and green corridors (creeks, wildlife corridors, trails, etc.) are integrated throughout the area. Large playfields are discouraged due to grading requirements. Site and topographic responsive pocket parks, enhanced viewpoints, graded hiking and walking trails, children’s play areas, including ‘tot lots’ and outdoor exercise areas are strongly encouraged on hillside areas.
- This area allows for Neighbourhood Centres to emerge in the form of high and medium density clustered mixed-use nodes
- Transit stops are located where appropriate

### DEVELOPMENT PERMIT AREAS
The subject site is not located within any of the City’s Environmentally Sensitive or Hazardous Development Permit Areas. However, if the proposed text amendment is approved, the proposed development will require a Form and Character Development Permit under Appendix U: General Design Guidelines for Carriage Houses prior to issuance of a Building Permit.

### COMMENTS

#### DEVELOPMENT PROPOSAL
The applicant has requested that the text of the R2 (One- and Two-Family Residential) zone be amended to permit a secondary suite within an accessory building at 3039 Glen Lake Road. The proposed secondary suite would be located on the ground floor of the existing 49.6m2 accessory building that is located in the rear yard and is located 1.5m away from the side property line and 7.6m away from the rear property line so the existing accessory building will conform to the required setbacks. Draft plans are shown in Appendix A and the applicant will be able to provide the three required parking stalls onsite.

If Council determines that the proposed development is appropriate, the R2 zone could be amended to permit a secondary suite in an accessory building on the subject property only.

#### NEIGHBOURHOOD CONSULTATION
The applicant has been advised that neighbourhood consultation should be undertaken prior to the Public Hearing of this application.

#### FRONTAGE IMPROVEMENTS
The Engineering Department has indicated that frontage improvements will be required prior to issuance of Building Permit issuance.

#### SEWER INFRASTRUCTURE
Sanitary sewer services are not currently provided on this section of Glen Lake Road, but the subject site is located within the West Shore Environmental Service contract area for sewer service. As a result, Section 6.1.2 of the Subdivision and Development Servicing Bylaw No. 1000 states that development (except any form of subdivision other than a strata subdivision of a two-family dwelling) may only occur without connection to the municipal sanitary sewer system provided the following conditions have been met:

a) The owner grants to the City a covenant under s.219 of the Land Title Act that requires the owner to connect the building to the municipal sanitary sewer system within 6 months of a sewer main being installed in a highway or City statutory right of way abutting the parcel on which the building is located;

b) Payment of the Sewer Capital Recovery Fee (SCRF) to West Shore Environmental Services or the City of Langford is made prior to the issuance of a building permit authorizing the construction of the building; and

c) Installation of all on-site plumbing necessary between the building and a point 1.0 m from the boundary of the highway or statutory right of way that the City designates as the future location of the sewer, to allow the building to be connected to the municipal sanitary sewer in accordance with the BC Building Code, and the works are installed in accordance with the permit prior to occupancy of the building. The City may require the owner to install works for either a 100 mm diameter gravity connection or a 50 mm diameter force main connection.

The subject property and the other 6 lots on Glen Lake Road that aren’t connected to sewer are relatively small (700 – 800m2 range) and therefore may not be conducive to redevelopment in the future so it may be prudent to have the applicant provide onsite plumbing as a condition of building permit.

### Staff Report to Planning, Zoning and Affordable Housing Committee - Part 2 of 2

Source pages: 4–22

#### FINANCIAL CONTRIBUTIONS
Amending the text of the R2 Zone to allow a secondary suite may increase the assessed value of the subject site, and this may in turn increase municipal revenue. As the applicant will be required to connect the development to municipal sewers when they are available, and as the applicant will complete frontage improvements, the direct capital costs to the municipality associated with this development will be negligible.

### OPTIONS
