## COMMENTS

### LOCAL GOVERNMENT ACT
Pursuant to Section 497 of the Local Government Act, the City may issue a Temporary Use Permit for a period of up to three years. The Local Government Act also allows a Temporary Use Permit to be extended for a maximum of an additional three years. If the holder of a Temporary Use Permit wishes to conduct the temporary use beyond this six year period, they are required to make an application to Council for a new Temporary Use Permit or apply for rezoning.

### COUNCIL POLICY
Langford’s Official Community Plan (OCP) describes the City Centre as a major employment area for institutional, office, commercial and light industrial uses, as well as a major regional growth centre that supports a wide range of high density housing, including affordable and rental housing. The OCP also includes the following general objectives and policies with respect to office and commercial uses in the City Centre:

Objective 3.2
Maintain a regional focus.

Policy 3.2.1
Commercial and institutional land uses, services and amenities in the City Centre will balance regional services with amenities for local residents.

Objective 10.1
Retain and encourage the growth of existing businesses and attract targeted new businesses to locate in the planning area.

Policy 10.1.1
Work with local business associations to support expansion of local and regional serving businesses located in the community.

Council has no specific policies regarding Temporary Use Permits, and each application for a Temporary Use Permit is considered based on its individual merit. However, Section 3.27 of Zoning Bylaw No. 300 provides guidance on where Temporary Use Permits may be issued, provides Council the authority to require conformity with the City’s Development Permit Areas, and the authority to require additional information for Temporary use Permit applications, including:

- Geotechnical evaluation;
- Environmental impact assessment;
- Wildfire hazard assessment;
- Stormwater management and drainage plans;
- Groundwater management plans;
- Soil removal plans;
- Acoustical analysis and sound attenuation plans;
- Traffic analysis and traffic impact mitigation plans;
- Parking studies and parking plans;
- Site lighting plans; and
- Visual impact analysis.

### DEVELOPMENT PROPOSAL

## DEVELOPMENT PROPOSAL

The proposed orthodontics office intends to occupy 335.6 m2 (3,612 ft2) of space in the existing multi-unit commercial building at 721 Station Avenue. The Service Commercial (CS1) Zone does not include offices as a permitted use, except on three specific properties located at the corner of Millstream Road and Meaford Avenue, just south of the subject site.

The applicant has indicated that the proposed orthodontics office is a new practice which may grow over time, but it is anticipated to operate three to four days per week between the hours of 8:30 a.m. and 5:00 p.m. with five employees, and potentially up to 30 clients per day.

The proposed use will be located in a long-standing existing building, and a Building Permit for tenant improvements will be required prior to any internal renovations or change in tenancy. As a result, it is not expected that a geotechnical evaluation, environmental analysis, stormwater management plan, groundwater management plan or soil removal plan will be required.

Council could request a Parking Study or Traffic Impact Analysis; however, as previously noted, the parking area at 721 Station Avenue contains 66 marked parking spaces which are shared between the various tenants. The proposed orthodontics office, classified as a medical or dental office for the purposes of Part 4 of the Zoning Bylaw, would require one parking space for 25 m2 of gross floor area, or a total of 13 parking spaces. For comparison, the following similar parking spaces would be required for other uses permitted in the CS1 Zone which could be established in this space without a Temporary Use or Development Permit:

- An animal hospital would require one space per 28 m2 of gross floor area (a total of 12 spaces);
- An auction room would require one space per 20 m2 of gross floor area (a total of 17 spaces);
- A gymnasium or health club would require one space per 25 m2 of gross floor area (a total of 13 spaces);
- A restaurant would require one space for every four seats; and
- A retail store (limited to a maximum of 200 m2 in this zone) would require one space per 20 m2 of gross floor area (a total of 17 spaces).

In addition, the previously noted Building Permit for tenant improvements will also include a review of the proposed use by City Departments, and the Chief Building Inspector/Business License Inspector will determine whether the proposed change of use and occupancy warrants a revised parking plan.

Other than new signage, which will be addressed through a future Sign Permit, the proposed orthodontics office will not include any alterations to the exterior of the existing building at 721 Station Avenue. As a result, it is not anticipated that a site lighting plan or visual impact analysis will be necessary.

In addition to this Temporary Use Permit, and in recognition that offices are permitted on several CS1 properties just south of the subject site, Council may wish to amend the text of the CS1 Zone to allow offices as a permitted use on this site, or in the Zone as a whole. Given the innocuous nature of the

proposed orthodontics office, the range of other uses currently established and permitted in the building, and the long-standing establishment of this commercial area, additional conditions are not recommended for this Temporary Use Permit.
