### Subject:
Application to Exclude 940 and 960 Latoria Road from the Agricultural Land Reserve

### Background

Source pages: 79–81

## Background

In 2015 Council directed staff to pursue a Block ALR Exclusion application for a number of properties in South Langford, including 940 and 960 Latoria Rd. This Block application was partially approved by the Agricultural Land Commission (ALC), with a condition that the City create an Edge Planning Policy, in June, 2016. The conditionally approved properties included several smaller parcels and the road right of way of developed roads, but not the properties located at 940 and 960 Latoria Rd. A short time later, the City received notification that the ALC Commission Chair referred this application to the Executive Committee of the ALC for reconsideration. The City has not received any update regarding the outcome of this reconsideration.

As part of previous rezoning applications for the adjoining McCormick Meadows development (Z14-0006 and Z16-0008), the City obtained a Right of First Refusal to purchase 940 Latoria and an Option to Purchase a portion of 960 Latoria Rd in the event it is removed from the ALR. These documents are registered on title and as such the City has an ownership interest in these lands.

### Commentary

## Commentary

Recently the owners of these properties, in consultation with the City, submitted a proposal to School District No. 62 (SD 62) as part of their recent Request for Proposals for a new school site in the West Shore. SD62 has expressed interest in utilizing these parcels for a new school site; however “Schools” are not a permitted use pursuant to Agricultural Land Reserve Use, Subdivision and Procedure Regulations. Due to this, SD62, City staff, and property owner representatives have discussed reapplying to the ALC for ALR Exclusion based on this new information regarding the intended use of the properties as a school site. At this time staff are seeking Council input regarding this application, and if supportive, authorization to undertake the required public notification which involves placing a sign on the property, placing ads in the newspaper in 2 consecutive weeks and notifying adjoining ALR owners.

### Financial Implications

## Financial Implications

The costs of public notification are expected to be approximately $1,200.

### Legal Implications

Source pages: 79–81

## Legal Implications

These notification measures must be complete prior to the owner submitting an application for exclusion. Should Council support this process, it is expected that the application may be submitted and reviewed by Council in February. Council does have an Agricultural Advisory Committee to advise them on ALR applications; however considering that these properties have already been reviewed by the City as part of the Block ALR Exclusion application, Council may wish to streamline the review of this new application and consider the application directly.

Furthermore, as noted the ALC is currently “reconsidering” the City’s Block ALR Exclusion application. Staff have not been able to ascertain a timeline from ALC staff with regards to this; however it’s possible that the ALC may be able to issue a decision for the reconsideration prior to the full consideration that will be required for this new application. Therefore, Council may wish to request that the ALC consider adding these properties to the list of properties approved for exclusion (with the Edge Planning Policy condition) under the Block ALR Exclusion application, in the event that this reconsideration will be issued in advance of a decision for this new application.

### Options

## Options

That Council:

Option 1

1. Direct staff to work in conjunction with SD62 and the property owners of 940 and 960 Latoria Rd to prepare a new ALR Exclusion application with regards to those properties, and proceed with the required public notification; and
2. Direct staff to request that the ALC amend their conditional approval originally issued in June 2016 for the Block ALR Exclusion application (ALR15-0002) to include 940 and 960 Latoria Rd among those properties identified as “approved for exclusion” as part of the reconsideration currently being undertaken by the ALC;

And either

3. Direct staff to prepare a staff report to Council with regards to this application once required notification measures are complete and the application is submitted to the City; or

4.  Direct staff to prepare a staff report to the Agricultural Advisory Committee with regards to this application once required notification measures are complete and the application is submitted to the City;

Or Option 2

5. Take no action at this time with respect to preparing a new ALR Exclusion application with regards to 940 and 960 Latoria Rd.
